Terms and conditions
General Terms and Conditions of entry to Achieve Events (UK) Ltd running events
In these terms and conditions the following definitions shall apply:
"Conditions" means these terms and conditions of entry for the Event.
"Entry Form" means the website pages or paper entry form which a Participant must complete in order to participate in the Event.
"Event" means the event named on the Entry Form.
“Event Rules” means the terms and conditions provided to Participants by the Event Organiser in relation to a specific Event from time to time.
"Event Organiser" means Achieve Events (UK) Ltd and registered in England & Wales with company number 08371074.
“Event Partners” means our commercial, charity and other partners in relation to the Event.
"Fee" means the price of entry into the Event, inclusive of VAT, as set out in the Entry Form but excluding any booking costs.
“Group Booking” means a paid reservation for two or more spaces on the Event, up to a maximum of 15 places.
“Group Leader” means the individual or organisation responsible for making a Group Booking.
“Guide Runner” has the meaning given in clause 2.14.
"Participant" means the person named on the Entry Form who will be participating in the Event. All references to Participants shall include Charity Participants and Guide Runners unless expressly stated otherwise.
“Personal data” has the meaning set out in the Data Protection Act 1998
1. Acceptance of Conditions
By submitting an Entry Form by or on behalf of a Participant (or, in the case of Participants within a Group Booking, by completion of the Entry Forms provided by the relevant Group Leader), the Participant agrees to enter into the Event and to accept these Conditions and the Event Rules, including where the Entry Form was submitted on their behalf.
REGISTRATION AND PARTICIPATION RULES
2.1 The minimum age of entry for all Participants is 17 years old on the day of the event.
2.2 The Participant acknowledges that participation in the Event is physically strenuous. The Participant acknowledges that participation in the Event will be physically demanding and the Participant is aware of the nature of the Event and associated medical and physical risks involved.
2.3 The Participant agrees that he/she is now and will be physically capable of competing in the Event and agrees to be solely responsible for his/her actions and the Event Organiser, its officers, employees, agents, volunteers, affiliates, associated companies, sponsors or medical advisers are not responsible for any injury or illness that the Participant may suffer as a result of his/her participation in the Event (unless caused due to the negligence of the Event Organiser). The Participant accepts that should any medical or physical condition arise prior to the Event which is likely to affect his/her ability to compete, the Participant will withdraw from the Event in accordance with these Conditions and as more specifically set out at clause 4. The Participant acknowledges the exclusion of liability and indemnity provided in clause 5 of these Conditions.
2.4 The Participant agrees to abide by all applicable rules and regulations of the relevant sporting governing bodies (including, as applicable, UK Athletics, the IAAF and England Athletics) that oversee the running of the Event including the relevant regulations and doping rules. The Participant shall not be entitled to a refund of the Fee if he or she is disqualified from the Event as a result of an infringement of these Conditions, the Event Rules or any such rules and regulations.
2.5 The Participant must complete the appropriate registration process at the times and on the day as instructed in the Event Rules which will be issued via email by the Event Organiser before the Event.
2.6 Participation in the Event is personal to you; you are strictly prohibited from swapping, deferring, selling or transferring or offering to sell, swap or transfer your place in the Event. If you are found to be in breach of this condition, your entry shall be rendered void and the Event Organiser reserves the right to exclude you from participation in future Events.
2.7 If your address details change after you have submitted your application, you can edit your contact details by accessing the registration system on the event website or by contacting email@example.com directly. Approximately 3 weeks before the Event, the Event Organiser will send your information pack to the address submitted on your Entry Form. If you do not receive your race pack, or if you lose it, the Event Organiser will be unable to send a replacement but you will be able to collect another information pack during the Event at the information tent.
MANAGEMENT OF THE EVENT
2.8 The Event Organiser may introduce cut off times as they see fit as part of the Event Rules, being limits on the time taken to complete sections of the Event (as initiated by the Event Organiser at its discretion) to ensure the safe and proper running of the Event. Subsequently, competitors may be instructed to withdraw from the Event in accordance with imposed cut off times.
2.9 The Event Organiser reserves the right at any time to remove Participants from the Event or prevent Participants participating in the Event if, in the Event Organiser's sole discretion, it considers such action necessary for safety reasons or the proper enjoyment of the Event by other Participants or for any other reasonable reason. No refund of the Fee shall be made if the Participant is removed due to having acted negligently, maliciously, with wilful misconduct or otherwise without due care for and attention to the Event or other participants.
2.10 While the Event Organiser takes every care with the staging of the Event, the Participant acknowledges that they are solely and personally responsible for the safety of their belongings. 2.11 All decisions and rulings by the Event Organiser, its employees and its agents are considered final. Accordingly, the Participant will comply with all Event Rules and all instructions and guidelines given by stewards, marshals, and safety personnel. The Participant acknowledges and agrees that the Event Organiser will organise and run the Event and will have sole authority and be the final arbiter on all decisions relating to the safety, running and organisation of the Event, the rules of the Event, the timings/finish times and the placings.
2.11 The Participant acknowledges and accepts that circumstances concerning an Event may change from time to time for reasons out of the Event Organiser's reasonable control or otherwise, without the Event Organiser incurring any liability and without any rights to withdrawal being accrued by the Participant other than set out in clause 4 below.
2.12 Unless the Event Organiser explicitly agrees, you are not permitted to use any other item that could potentially inhibit the flow or safety of other participants or which we, in our reasonable opinion, deem may cause danger or risk of danger to you or other participants, including but not limited to pushchairs, roller skates; wheel barrows; cycles; or hand cycles.
2.13 The Event Organiser will use best endeavours to provide an Event finish time for the Participant however it cannot be held responsible for any computer result anomalies or any technical malfunctions.
2.14 Entries from physically disabled, blind or visually impaired runners (Assisted Participants) are welcome, however all such participants must be accompanied by a supporting runner (Guide Runner), whose details should be entered on the Entry Form of the Assisted Participant. The Assisted Participant and his /her Guide Runner should be appropriately identified at all times during the Event, and must be physically linked together so as to properly assist the runner during the Event. All Assisted Participants and Guide Runners who submit an Entry Form each knowledge that (i) the Guide Runners are to accept responsibility for the Assisted Participant completing the Event safely and (ii) the Event Organiser may not take extra precautions in arranging the Event to specifically accommodate the Assisted Participants.
2.15 We welcome entries from wheelchair participants, who will be subject to the rules of the IPC. Elite wheelchair participants will start before the main field.
2.16 Hand cycles are NOT permitted.
3. Bookings and Payments
3.1 This clause only applies to individual bookings, including bookings made on behalf of a participant. For Group Bookings please see clause 3.4.
3.2 In consideration for being granted the right to participate, the Participant (or the individual booking on the Participant’s behalf) must pay, or authorise the payment of, the Fee and any associated booking costs by no later than the closing date set out on the Entry Form.
3.3 The Participant shall not be eligible or entitled to participate in the Event until the Entry Form has been completed in full and submitted and full payment of the Fee and associated booking costs have been received by the Event Organiser.
3.4 Group Bookings are permitted for this Event. In such cases, payment of the Fee (on behalf of Participants within the Group Booking) shall be made by the Group Leaders. The Fee shall be paid no later than the closing date set out on the Entry Form.
3.5 Group Leaders acknowledge that each Participant within the Group Booking have consented to their details being submitted as part of the Entry Form. Group Leaders are responsible for ensuring the information entered on the Entry Forms are accurate and for ensuring that all Participants within the Group Booking have read and understood these Conditions. If the Group Leader is found to be in breach of this condition, the Group Booking shall be rendered void and the Event Organiser reserves the right to exclude all relevant Participants from participation in future Events.
4. Withdrawal, Cancellations or Alterations
CANCELLATION BY US
4.1 Participants may be entitled to a full refund of the Fee, with no further liability whatsoever arising from the circumstances, in the following scenarios:
(a) if the Event Organiser withdraws the offer of a place to the Participant in the Event for any reason at any time (except where such withdrawal is in accordance with clauses 2.4, 2.6 or 2.9 of these Conditions);
(b) if the Event Organiser cancels the Event (except where such cancellation is due to circumstances beyond its reasonable control); or
(c) if the Event Organiser changes the date of the Event and the Participant is unable to attend on the revised date (provided that the Participant informs the Event Organiser that it cannot attend on the revised date no later than 1 week from receiving notice of the date change).
4.2 The Event Organiser shall not be liable for any other costs incurred by the Participant in addition to the Fee (including, but not limited to, travel and accommodation costs) if the Event is cancelled, changed or a Participant's place is withdrawn.
CANCELLATION BY YOU
4.3 The Participant may withdraw from the Event at any time, in accordance with clause 4.4, but the Event Organiser shall not refund any part of the Fee to the Participant upon, as a result of or otherwise in connection with their withdrawal from the Event.
4.4 Notice of withdrawal from the Event must be communicated by emailing firstname.lastname@example.org. Withdrawals WILL NOT be accepted by telephone.
5. Event Organiser Responsibilities/Liability
5.1 In no event shall we be liable to you whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with these Conditions for any:
- Loss or damage;
- Loss of profit;
- Loss of reputation;
- Loss of business, revenue or goodwill;
- Loss of anticipated savings;
- Donations made on behalf or by you to charity;
- Consequential or indirect loss, regardless of whether the loss or damage would (i) arise in the ordinary course of events (ii) is in the contemplation of the parties, or otherwise.
5.2 Nothing in these Conditions shall affect our liability for death or personal injury, fraud or fraudulent misrepresentation, or any other liability to the extent it cannot be excluded or limited by law.
5.3 This clause 5 shall be read and construed and shall have effect subject to any limitation imposed by any applicable law.
6. Use of Image
6.1 The Event may be televised, filmed and/or otherwise recorded and photographs may be taken all of which may capture your participation in the Event. You agree to the publication of such photographs, filming, recording and broadcasts and their use by us and those authorised by us in any way which we may see fit now or in the future including but not limited to film, broadcast, radio, TV, publications and publicity.
6.2 Any audio, visual, or audio-visual recordings that you make of the Event or any part of it are for personal use only and cannot be used for any commercial purpose.
7. Data Protection
7.1 The type of information we may collect about you includes: (a) your name and address; (b) your phone number and e-mail address; (c) details about the services you specifically request; (d) your gender and date of birth; (e) whether or not you have a medical condition; and (f) whether or not you are a wheelchair user. If you are the parent/guardian of a child/minor entering the Event, we will hold details about the child/minor as well as you.
7.2 The information you provide to us will be processed for the following reasons: (a) in connection with organizing, staging and administration of the Event; (b) to send you information about the Event, including the Event Rules, important updates on the Event, health and safety information and training information; (c) to publish on the Event Organiser’s and associated partners’ websites the results of the Event (including your name, gender, any club affiliation, race time and age category); (d) to comply with our insurance, permits, regulatory or legal obligations; and (e) adding you to mailing lists, as detailed further below. We and our partners may also anonymise your Personal Information in order to compile statistical information and improve health and safety procedures at future events.
7.3 Unless you tick the relevant box on your Entry Form, you will be added to our marketing mailing lists to (i) promote and market the Event; (ii) keep you informed about any future events and services organised/provided by the Event Organiser (or any other Company in our Group) which we believe you might be interested in; and (iii) to keep you informed about products and services offered by our Event Partners.
7.4 If you did tick the box, but would no longer like the Event Organiser or the Event Partners to use your Personal Information for the purposes set out in paragraph 7.4, please click on the unsubscribe link at the bottom of the marketing e-mails.
8.1 These Conditions shall apply in place of and prevail over any terms or conditions (whether or not in conflict or inconsistent with these Conditions) contained or referred to in any documentation submitted by the Participant or in correspondence or elsewhere or implied by trade custom, practice or course of dealing.
8.2 These Conditions (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event.
8.3 If any provision of these Conditions is invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.
8.4 These Conditions shall be interpreted in accordance with the laws of England and Wales and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the English Courts.
